Applicable Legislation

Purchases made through the Artesanía de Frigiliana Website and under these Sale Terms are subject to Spanish law.

Competent Jurisdiction
Any dispute or discrepancy arising from the application or interpretation of these Sale Terms, as well as the contracts incorporating them, shall be resolved in the courts of the City of Málaga, Spain, which will have exclusive competence over any other jurisdiction.

2.2. How to Place an Order

Placing an order through Artesanía de Frigiliana consists of the following steps:
1.    Choose the products desired and click to "Add to cart".
2.    Proceed to check out.
3.    Log into your account or create a new account.
4.    Introduce the delivery and billing information.
5.    Choose a method of payment and click on "Send Order". By activating the "Send Order" button on the order form, the Customer fully and without reservation accepts all the Sale Terms as per the Website at the moment of contracting.
6.    Make the payment.
7.    If the payment is authorised, the Customer will receive confirmation of receipt of the order. With the exception of the circumstances described in Sections 2.3 and 2.4 below, this confirmation constitutes acceptance by Artesanía de Frigiliana of the Customer's order and creates a binding agreement between Customer and Artesanía de Frigiliana.
It is recommended that the Customer prints and/or saves a copy of the Sale Terms when placing the order.
A copy of the confirmation of receipt will be sent to the Customer' e-mail address. It is recommended to print or download the copy for possible future consultation.
Artesanía de Frigiliana may change the Sale Terms at any time, without prior notice to the Customer. However, Artesanía de Frigiliana will announce such changes on the Website. Also, once the Customer has received confirmation of receipt from Artesanía de Frigiliana of his/her order, the Sale Terms applicable to that order will not be changed.

2.3. Availability of Products

The completion of an order through the Website is subject to the availability of the products. Artesanía de Frigiliana attempts to guarantee stock of all garments on sale.
If the product ordered is not available or there is no stock of it, the Customer will be informed by e-mail and refunded the amount paid within 30 days of the payment.

2.4. Artesanía de Frigiliana' Right to Cancel or Not Accept an Order

Artesanía de Frigiliana reserves the right to reject any order as well as cancel or not accept a confirmed order for, amongst others, the following reasons:
•    There was a technical or pricing error on the Website at the time the order was placed.
•    The ordered product is not available.
•    The billing information given was incorrect or unverifiable.
•    Security systems indicate that the order is abnormal or may be fraudulent.
•    Artesanía de Frigiliana has been unable, after 3 attempts, to deliver the order at the address provided.
If an order is cancelled for any of the above reasons, Artesanía de Frigiliana will refund (if applicable) the value of the order. Delivery expenses are never refunded, except in certain circumstances.

2.5. Verification of Data

Prior to processing an order placed by the Customer, Artesanía de Frigiliana may verify the Customer' data. This may involve verification of the address and solvency of the Customer, and whether fraud is involved. With respect to possible fraud, Artesanía de Frigiliana may use partially automatic verification of all purchases in order to filter out those considered abnormal or suspicious and those suspected of fraud. Orders suspected of fraud will be investigated, and the Customer may be reported to the appropriate authorities, which may prosecute.

Price and Payment

3.1. Prices and Currency

The prices and offers presented on the Website include Value-Added Tax ("VAT") and are valid only for orders placed on-line through the Website.
Prices are given in Euros and do not include processing and delivery charges.
Artesanía de Frigiliana informs that changing the delivery country may have an impact on the price due to the exchange rate.

3.2. Method of Payment

To pay for the order the Customer may use the following methods of payment:
- Bank deposit/transfer for Eurozone countries, delivery fees will be added on top, once the purchase is complete Artesanía de Frigiliana' bank account number will be provided. Items will be shipped once once the deposit into our account has been completed. Please indicate your name and surname and order number to avoid confusion. The charge will be made upon confirmation of the order.
- Credit or debit cards via PayPal
- PayPal. This method of payment is valid for any purchase, delivery fees will be added on top, once the purchase is complete the Customer will proceed to the PayPal website where your purchase will be completed after logging in. The Customer will then return to artesaniadefrigiliana.com to confirm the order, if this confirmation does not arrive, please contact us immediately at info@artesaniadefrigiliana.com.
Once your order has been confirmed Artesanía de Frigiliana will issue an invoice with the address the Customer has provided. Please provide fiscal details while placing the order, invoices will not be changed once issued.

3.3. Changes in Price

The prices shown on the Website are subject to change. Artesanía de Frigiliana reserves the right to change prices without prior notice. However, once the confirmation of receipt of an order is received from Artesanía de Frigiliana, the price payable in respect of that order will not be changed.
Artesanía de Frigiliana informs that despite careful updates of the Website the prices shown may be erroneous. Any prices shown in error will be amended as soon as possible and shall not be binding on Artesanía de Frigiliana.


3.4. Value-Added Tax

To comply with current VAT distance selling regulations, deliveries will be assumed to take place in the Member State indicated in the delivery address.
Thus, any purchase made through the Website will be subject to VAT. The VAT will be at the legal rate in effect in the Member State where the goods of a given order are to be delivered.
Customers outside VAT territories: according to Artesanía de Frigiliana VAT policy, customers in these areas purchasing from the Website will be charged VAT when placing an order.

Delivery

4.1. Delivery: Where and When

The deliveries are made from Monday through Friday. No deliveries are made on weekends or local holidays.
Deliveries are made during business hours. Thus, to facilitate delivery, the Customers are asked to use their work address or any other address where there might be someone to receive the package.

4.2. Lead Time

Spanish peninsula: orders are usually delivered within the 72/ 96 business hours following the receipt of payment to the address specified by the client as long as the item is in stock.
For deliveries to the Canary Islands, Ceuta, Melilla and Andorra please contact us for delivery charges. Nonetheless if the delivery is via courier you may be charged tax by customs, IGIC, etc.
EU deliveries: Fee will depend on the country, weight and volume of the purchase.
Courier deliveries via DHL will be carried out within 10 business days after purchase at the address specified by the client as long as the item is in stock. This courier has a insurance (for loss and misplacement) and there are no limits as far as the size of the package is concerned.
Delivery date may change depending on the destination country, land transport is chosen by default, if you have an urgent order that requires air freight please ask for applicable fees via our email address info@artesaniadefrigiliana.com . Nonetheless you may be charged import tax by customs, IGIC, etc. these charges are the Customer's responsibility and shall be paid upon receipt of goods.
Mail deliveries will be carried out between 10-15 business days after purchase at the address specified by the client as long as the item is in stock. If delivery is not possible, a notification note will be left so the Customer can pick the parcel up at the nearest post office. This type of delivery only offers insurance for loss and misplacement NOT for damaged goods. The package's maximum dimensions must meet the following criteria: length + width + height = 200 cms, none of which can be more than 105 cms.

4.3. Logistics

If there is a delay in sending your package, we will contact you via email or telephone with the new delivery date.
Should your package be returned to us due to Customer error when specifying the delivery address, the Customer will have to pay the delivery charge again.

4.4. Return Policy

Right of Withdrawal

If the Customer is not satisfied for any reason with the products purchased, he/she will have 7 business days or 10 calendar days from the delivery date to return the product with no need for an explanation of any kind. The Customer may return the purchased product, provided that the Customer must assume the expenses of this return. The products are to be returned with their original packaging and labelling. If the product has been opened and/or manipulated the return shall not be accepted.
Upon satisfactory inspection of the returned goods, Artesanía de Frigiliana will refund the price of the product. The delivery expenses are never refunded (except in case of incorrect or defective items); the customer will also have to pay for the return expenses. Returns sent by "Pay on Delivery" method will not be accepted.

4.5. Information on Refunds

In order to request your refund you must:
-email info@artesaniadefrigiliana.com
-pay the correct postage amount
-send the product original with its original packaging and labelling to the address on the invoice
-attach the invoice
- add a brief description of the problem with the product
-indicate whether you want an exchange or a refund
The refund will be made in the same manner as the original payment as long as the products are in the same condition as when sent to the Customer.

4.6. Verification on Receipt

The Customer must verify the state of the packaging upon delivery. If the package is damaged, the Customer must email info@artesaníadefrigiliana.com.  Artesanía de Frigiliana informs that the delivery must be verified within a reasonable time after receipt. In case no notice of rejection of the products is received within 24 hours of delivery, Artesanía de Frigiliana will consider the Customer to have accepted the delivery. No returns are possible if Artesanía de Frigiliana has not been contacted within 24 hours from receipt of the package.

4.7. Returns

Follow the procedure outlined in 4.5 once the condition of the returned product has been verified, the Customer will be refunded the relevant amount in the form of customer credit towards a future purchase or a deposit to the bank account number the Customer provides.
